Child Restraint & Seat Belt Laws
Changes to VA Child Passenger Law - Effective July 1, 2007
  • All children under age eight must be properly restrained in a child safety seat or booster seat.
  • Rear-facing child safety seats must be secured in the back seat of a vehicle.
  • Children cannot ride unrestrained in the rear cargo area of a vehicle.
  • Current Virginia Child Safety Seat Laws Fact Card


The law applies to anyone (parents, grandparents, babysitters, friends) who provides transportation for a child in any vehicle manufactured after January 1, 1968. Violations will result in a  fine. Law enforcement officers can and will stop and ticket any driver of a vehicle where children under 16 years of age are not properly and safely secured.

Rear-Facing Seat

From birth to at least one year and 20 pounds and reclined at a 45 degree angle

Forward-Facing Seat

Age one and 20 pounds to about four and at least 40 pounds (seat weights may vary)

Backless Booster Seat

Used with Vehicle Lap and houlder Belts
From age four to age eight and under 57" tall

High-Back Booster Seat

High-Back Booster Seat
From age four to age eight and under 57" tall

Older Children
All children between eight and 18 must be properly restrained by a child restraint system or a safety belt. Violations will result in a  fine.
